Headword: *)ati/mhtos a)gw/n
Adler number: alpha,4364
Translated headword: unassessed lawsuit
Vetting Status: high
Translation:
['Unassessed' lawsuit and 'assessed': 'assessed' means] the one for which no assessment[1] is established that is specified in the laws; instead, what the litigants ought to suffer or pay was assessed [sc. by the jury each time]. But the '[un]assessed' [suit is the one] in which there is a specified assessement [coming] from the laws.
Greek Original:
*)ati/mhtos a)gw/n: e)f' w(=| ti/mhma w(risme/non e)k tw=n no/mwn ou) kei=tai, a)ll' oi( dika/zontes e)timw=nto ti/ dei= paqei=n h)\ a)poti=sai. o( de\ timhto\s, w(=| pro/sestin a)po\ tw=n no/mwn w(risme/non ti/mhma.
Notes:
Carelessly (or perversely?) abridged from Harpokration s.v., commenting on this technical term's occurrence in Aeschines (3.210) and Demosthenes (21.90). The first pair of square brackets in the translation above indicates what the Suda has missed out, and by so doing made the entry say (with the help of a change from 'unassessed' to 'assessed' in the final sentence) the exact opposite of what it should.
[1] In the sense of penalty, financial or other.
