A name of a lawsuit [sc. in classical
Athens] brought by those claiming that they are being excluded from their own property, against those excluding them. Accordingly the name derives from [the verb]
exillein, which is to expel and thrust out and throw out.[1] Also subject to a
dike exoules, in addition to the [sc. usual?] penalties, were those who did not recover [their property] within the appropriate statutory period, once the date fixed for reclaiming the adjudicated items had been exceeded. Those convicted of ejectment gave back to the plaintiff what they took of his and also paid the assessed sums to the public treasury. Someone else who used to initiate a
dike exoules was the creditor attempting to get his hands on a possession of the debtor and being prevented by someone/something. And if someone be prevented from working their land, the law gives him the right to bring a
dike exoules against the preventer. And [sc. likewise] concerning a slave and everything which someone claims he has a share in. But
Dinarchus has used the term
exoule in a particular sense, from the priestess who was refusing to perform her own duties.[2]
